The following terms and conditions (henceforth: the TCs) are valid between you and By Andrada SRL (henceforth: L’aoriri ; may be referred to as “us”, “we”, “L’aoriri”, ”our website” or “website”). These terms and conditions set out the legal terms that apply to your use of our website https://www.laoriri.com.

Please make sure you read and fully understand our Terms & Conditions before placing any orders with L’aoriri. If you are using a guardian’s credit or debit card to make a purchase you must let your guardian know about our Terms & Conditions and Privacy Policy before subscribing and/or signing up to our site. By using these services, you are agreeing to all of these terms that may vary accordingly to modifications and updates. Any orders placed for a product for sale on the website implies the acceptance of these General Terms and Conditions. We may modify the Terms & Conditions and Privacy Policy from time to time. The date of the latest update is found in the final section of the Terms and Conditions. Each purchase is subject to the Terms and Conditions in the version applicable at the date of submitting the order.

These general terms of sale are governed by the laws of Romania, save for any mandatory provisions to the contrary under the Rome Convention on the law applicable to contractual obligations of June 19, 1980.

Please note that L’aoriri does not guarantee that all products presented on the website are in stock or are available for purchase.

3. Website accessibility

Our website is generally accessible to all users of the Internet network on a continuous basis, 24 hours a day, 7 days a week, except in the event of interruption, whether planned or unforeseen, by L’aoriri or its service providers, for maintenance and/or security purposes or due to a force majeure event (as defined below). L’aoriri shall not be held liable for any losses resulting from the unavailability of the website.

L’aoriri does not warrant that the website will be free from anomalies, errors, or bugs, nor that they will function without disruption or interruption. Accordingly, L’aoriri reserves the right, at its sole discretion, to determine any period during which the website or its content may be unavailable. Additionally, L’aoriri shall not be held responsible for any issues related to data transmission, connection, or network availability.

L’aoriri retains the right to modify the website for technical or commercial reasons. In cases where these modifications do not materially and adversely affect the terms of service provision, the Customer may be notified of such modifications, but their explicit acceptance shall not be required.

To be a customer of our website you must be a consumer, of legal age and with full legal capacity, and you can reside anywhere in the EU.

To establish an account, click on “SIGN UP” and provide your details. While we’re certain you’ll enjoy being among the first to receive L’aoriri news, you retain the option to cancel your subscription anytime by utilizing the opt-out feature or by notifying Customer Care at hello@laoriri.com.

6.Privacy policy

When making an online purchase, you provide us with personal data such as your name, email address, telephone numbers, and addresses. This data is retained to process and deliver your orders. You also consent to sharing your card/bank details with our secure payment partners, EuPlatesc, Stripe, Google Pay and Apple Pay, and your contact details with our nominated couriers (Cargus,FedEx) and distribution facilities for order delivery and related communications. We accept no liability on behalf of our payment partners, couriers, or distribution facilities.

Creating a L’aoriri account or placing an order on our website grants us consent to retain personal data, including your name, email address, telephone numbers, and addresses, for order processing and delivery purposes.

We collect information regarding sales, wish lists, and other commercial data, which may be shared with our third-party payment and billing platforms.

7.Your rights

You possess specific rights under Romanian law, including:

8.Ordering from us

Upon selecting your items and placing your order, you will receive an email acknowledging the details of your order. Please note that this email serves as confirmation of receipt, not as acceptance of your order. Unless you opt to cancel your order, the acceptance of your order and the conclusion of the contract between you and L’aoriri will occur when we dispatch the goods and subsequently notify you via email.

We retain the right to decline your order if we do not secure payment authorization, encounter shipping restrictions for a specific item, or find the ordered item to be out of stock and not explicitly on back order. Additionally, we reserve the discretion to refuse processing and acceptance of any transaction for any reason, or to decline service to any individual at any time. We shall not be held liable to you or any third party for withdrawing any product from the website, irrespective of whether said product has been sold out.

In the event that a product becomes unavailable, we will promptly reach out to you via email or phone. If payment has already been processed for the unavailable product, we will initiate a refund for the purchase amount.

We may attempt to communicate with you via email or telephone to obtain additional information regarding your order.

In circumstances where we are unable to reach you for further details and confirmation of the order, your order will be canceled. Please be aware that our attempts to contact you for additional information are motivated by our commitment to ensuring your satisfaction with your order, and we strive to provide the best service possible in this regard.

9. Cancellation policy

Order Cancellation Procedure:

 

• • • You can initiate the cancellation of your order by contacting our customer support team via email or phone or using your L’aoriri account.
    • Kindly include your order number and the reason for cancellation in your request.

 

Cancellation Deadline:

 

• • • If your order is “custom size”, you may cancel your order free of charge within 48 hours of its placement.
    • Should you wish to cancel your “custom size” order after the initial 48-hour window, but prior to its dispatch by our courier, a cancellation fee will be applicable.

 

Cancellation Charges:

• • The cancellation fee encompasses: ROMANIA: €10 / EUROPE: €50

 

Please note that this cancellation policy is subject to revisions, and we recommend periodic review for any updates. By placing an order on our website, you agree to adhere to this cancellation policy.

10. Pricing policy

The prices listed are in EURO and include VAT.

On our website, you have the option to view prices in EUR using the currency converter tab within the shop section. While the currency converter is linked directly to XE and utilizes real-time rates, prices displayed in currencies other than EUR are only indicative. The rates employed will vary and are subject to the spot rates applied by your credit card or account provider.

Please note that L’aoriri does not provide price adjustments on items originally purchased during a sale or promotion, even if temporarily discounted. Once an item has been purchased at a reduced price, no adjustments will be made should a subsequent sale or price reduction occur.

11. Colors

While our aim is to provide accurate product descriptions on the Website, it’s important to acknowledge that variations in color may occur due to individual computer color settings. As a result, the colors of the products depicted in the website images may slightly differ from their actual colors. L’aoriri cannot be held accountable for such disparities; however, you have the option to return any item that does not meet your expectations regarding color, in accordance with our Return Policy.

12. Payment policy

1. We accept payments via Mastercard, Visa, American Express processed via Stripe (all card details here), one of our secure payment provider.
2. We accept payments via Visa and Mastercard through EuPlatesc.ro , a secure payment gateway provider. Details of accepted payments are here (https://www.euplatesc.ro/acasa/suport/servicii-carduri/).
3. We also accept payments through Google Pay (https://pay.google.com/intl/ro_ro/about/) and Apple Pay (https://www.apple.com/apple-pay/). 
4. By making a purchase, you confirm that the credit/debit card used belongs to you or that you have explicit authorization from the card owner. All cardholders undergo validation checks and authorization by the card issuer. If your payment card issuer declines payment to L’aoriri, we won’t be responsible for any delays or non-deliveries.

While we take reasonable measures to keep your order and payment details secure, we cannot be held liable for any losses resulting from unauthorized access to your data, unless negligence on our part is proven.

13. Stores credit cards

At Checkout, you can chose to save your payment cards for future purchases if L’aoriri or its payment providers offer this service.

14. Shipping policy

We ship to Romania and all European Union member states. At the time we unfortunately do not ship internationally worldwide. If you want to order from India however, we suggest you order directly from our production atelier. Send us an email hello@laoriri.com and we’ll put you in contact with them.

L’aoriri works mostly on pre-orders/on demand production. That means, we keep a very small stock available for sustainability purposes and create the garments based on demand. Once your order is made we notify our atelier. If there is a piece in our stock it is shipped within 1-5 days, if it’s not in stock, they create and ship it within 7 working days. Once it reaches Romania, it will be packed and shipped forward towards you. This entire process can take between 15 to 21 working days. You will receive a tracking no. once the package has left from Bucharest towards you. If you have any questions about the process or your order you can contact us at hello@laoriri.com.

Order processing occurs Monday to Friday, from 10AM to 6PM GMT+2. Please note that orders placed over the weekend will be processed on Monday.

For European orders, we use FedEx shipping. Transit times after dispatch may vary depending on location, typically ranging from 1 to 5 days for all international orders. This delivery is subjected to change based on FedEx services.

Domestic orders are shipped via Urgent Cargus, with customers typically receiving their orders within 1-2 business days from shipment. This delivery is subjected to change based on Urgent Cargus services.

15. Return policy

We prioritize our customers’ satisfaction and offer a comprehensive return policy. If you’re unsatisfied with your order for any reason—whether due to size issues, product discrepancies, or manufacturing defects—you have the right to return it.

Returns are accepted within 14 days from the day your order arrives at the delivery address. Please ensure that returned items are accompanied by a filled-out Return Form, which is provided within any package.

Returned items must adhere to the following criteria:

 

• • • Unworn, undamaged, unwashed, and unused

  
  

  • • All tags attached and original packaging included

  
  

  • • Final sale items can’t be returned unless damaged or faulty upon delivery

  
  

  • Made-to-order/ Custom size items can’t be returned, except if damaged or faulty upon delivery, with possible necessary alterations.

If you believe the purchased item is faulty please write us an email on hello@laoriri.com with attached images of the faulty item.

For added convenience, we can arrange a delivery pick-up at your location through our delivery company. Simply email us with the pick-up details, and we’ll  provide a shipping label for printing and attaching to the parcel. The cost of pick-up and shipping will be covered by us.

We advise retaining proof of return, such as a consignment note, in case of disputes. Excessive and unjustified returns, exceeding two instances in violation of our terms and conditions, may result in refusal of future orders at our discretion.

Once we receive your return, processing may take up to 5 working days. Refunds are issued to the original payment method, excluding delivery costs. Refunds may take up to 14 days to reflect in your account, depending on your payment provider. In case if payment cannot be refunded to original payment method then a bank account details will be needed. Bank account must belong to the customer of the original order. Further validations for authenticity of the account may be requested to ensure that the payment is made to the correct person.

By placing an order on www.laoriri.com, you confirm that you are acquiring products for personal use, not for resale, and that you agree to the Terms and Conditions. We retain the right to decline orders for any reason without providing explanation.

We reserve the right to pursue all available remedies for violations of these Terms and Conditions, including the ability to block access to the site.

19. Governing laws

These Terms and Conditions are governed by the laws of Romania. Any disputes arising from or relating to these Terms and Conditions shall be subject to the jurisdiction of Timișoara.

The content on this Site is the exclusive property of L’aoriri. This content encompasses, but is not limited to, all photographs, images, illustrations, texts, video clips, drawings, logos, registered trademarks, graphics, and other materials displayed herein. All rights are reserved globally.

L’aoriri online store strives to present its products and colors with utmost accuracy. However, we cannot guarantee that the color displayed on your monitor will perfectly match the color of the goods delivered. While we endeavor to offer precise and meticulous service, technical, factual, or printing errors may occasionally arise. Therefore, our website retains the right to modify and rectify the website as necessary, without prior notice. Any errors found will be promptly corrected, and L’aoriri reserves the right to retract any stated offer and rectify any technical errors, inaccuracies, or omissions, even after an order has been confirmed and regardless of whether payment has been processed.
